Govt defies Comcare Review

The transfer of OHS coverage for self-insurers from Comcare to the states and territories remains on the table despite the Comcare Review recommending that Comcare retain OHS coverage for self-insurers.

When releasing the long-awaited Comcare Review, the Federal Workplace Relations Minister Julia Gillard said that given the proposed transfer of OHS coverage for self insurers from Comcare to the states and territories, the Government-imposed moratorium on new entrants to the Comcare scheme would remain until uniform OHS laws had been implemented in all jurisdictions.
 
The Government will introduce legislation to give effect to the extended moratorium.
 
Minister Gillard said she would also direct Comcare to strengthen OHS enforcement and write to Comcare asking it to publish guidance material on improving employee consultation on OHS.
 
In relation to Comcare’s workers compensation scheme, among a range of changes, a statutory time limit would be placed on the determination of claims and compensation coverage for off-site recess breaks would be reinstated.
